Sep 25 - Man Jailed For Child Porn And Voyeurism

A 29-year-old man was jailed for three years and eight months for several charges including downloading and distributing child porn and voyeurism.

Colin Fisher appeared at the Supreme Court today and was sentenced for one count of possession of indecent photographs of children, one count of distribution of indecent photographs of children and five counts of voyeurism.

Fisher was arrested in March earlier this year following an extensive investigation by the RGP Safeguarding Unit, in conjunction with Interpol USA.

Following investigations, Fisher was found to be in possession of 48 images of child pornography. The second count of distribution of 150 indecent images of children was said to be the most serious offence.

Chief Justice Anthony Dudley said: “The sample photographs I have seen clearly show that the victims are pre-pubescent children.

“I make the point of using the word “victims” because viewing and distributing these images is most certainly not a victimless crime, because at some point a child has been abused and the existence of a market for these images undoubtedly fuels the abuse of children and the creation of even more horrific images.

“It cannot be doubted that the children involved in these images will to different degrees have suffered distress, fear, corruption, in some instances physical injuries and in most cases psychological and emotional harm.

“The depravity involved in creating these images but also in wishing to view them and disseminate them is beyond comprehension to any right-minded individual.”

With regards to the counts of voyeurism, count three related to a video recording of Fisher having sex with a woman, which was taken without her knowledge. He was also charged with one count of voyeurism for producing a still image of him and a woman having sex and making it available to a third party.

The remaining counts of voyeurism relate to Fisher secretly installing recording devices in the staff changing rooms in King’s Bastion Leisure Centre, where he worked as a manager. The court heard these recordings were stored on his mobile phone and showed two female members of staff stripping to their underwear.

A psychiatric report revealed Fisher suffered from mental and behavioural disorders due to multiple drug use and the use of psychoactive substances. The Crown heard there were personal struggles which had an impact on Fisher’s actions.

While sentencing, the Chief Justice broke the sentences down to three sets which must be served consecutively. Fisher was sentenced to 18 months for one count of possession of child pornographic images, 32 months for distribution of child pornographic images, and both counts are to be served concurrently. With regards to the charges for voyeurism, Fisher was given eight months for each count of voyeurism for videoing and sharing the image of himself and the woman having sex without her consent, which is to be served concurrently. He was also sentenced to four months in prison for three counts of voyeurism relating to installing recording equipment which is to be served concurrently as well.

Fisher has already served six months in prison since he was remanded in custody, which will be taken in account.

Senior Crown Counsel Damian Conroy appeared for the Crown, while Justin Rodriguez appeared for the defendant.
