May 05 - Rape Trial Continues At The Supreme Court

A Supreme Court trial is underway for a 28-year-old man accused of raping a teenage girl.

Darryl Martinez, of Glacis Estate, faces seven charges including three of sexual assault, one of rape and one of having sex with a girl (‘A’) under the age of 16.

The Crown heard Martinez was visiting A’s house with friends in February 2012 and, during the course of the weekend, allegedly forced himself on her.

The defendant faces two further charges of attempted rape and indecent assault against another girl – ‘B’ - aged 14 in a separate incident on an unspecified date between 2009 and 2010.

Giving evidence in court today, A’s father described her as a private and shy person. He explained how she had suffered abuse while living with her mother and that once he was given custody of his daughter and her brother, they’d moved to Gibraltar.

Westside School Head Teacher Michelle Barabich also gave evidence. She said she had worked closely with A while she was a pupil at the school and said she was very withdrawn and had low self-esteem.

Mrs Barabich said that the teenage girl had told her about being tied up by the defendant and days later admitted to have been forced to have sex with him, when she set up a meeting with A’s father and urged them to speak to the RGP.

Prosecutors Ricky Rhoda QC and Kerrin Drago appear for the Crown. Keith Azopardi QC and Justin Rodriguez appear for the defendant.

The trial continues tomorrow and is expected to last for nine days. 

The alleged victims’ identities have been protected.
