Sep 18 - Government “Vindicated By Court” In Montiel Case

The Government says it is very pleased to note the decision this morning by the Chief Justice, Mr Justice Dudley, dismissing the claims made by former GSD Minister, Louis Montiel.

The claims made by Mr Montiel seeking to force the Government to admit him to the Civil Service have been dismissed.

Mr Montiel's actions against the Chief Secretary and the Minister for Employment, Mr Joe Bossano, have all been entirely dismissed.

Mr Montiel had been re-engaged by the Gibraltar Development Corporation after he left Parliament. The Court has ordered that his re-engagement should have been effective some weeks earlier than had been agreed.

Moreover, Mr Montiel's additional claim for a higher salary has also been dismissed.

The Court has also awarded the Government 75% of its costs in this action, by far extinguishing any amounts due to Mr Montiel.

Chief Minister, Fabian Picardo, said: "The Government had to defend claims made by Louis Montiel which were clearly abusive. The court's judgment, dismissing virtually all claims made, vindicates the Government's decision to defend these proceedings. A person cannot for their own benefit seek to rely on the policies of the government of which he was a member when a different government with a different policy has been elected. That was always clear to us. It is now hopefully clear to Louis Montiel too."
