Sep 22 - Chamber Displeased with Recent Bullying at Work Legislation

chamber logo The Gibraltar Chamber of Commerce has expressed concern over the recently implemented Employment (Bullying at Work) Act 2013. They claim that although it addresses an objective shared by all members, it is drafted in such a way as to create unwanted and unnecessary hurdles for business.

The Chamber formerly made representations to Government to amend the legislation so that it would be implemented in a way which would ‘make it less susceptible to abuse and had highlighted that there are inherent inequalities in the law as drafted so that an employer could be found liable for bullying in circumstances where he or she are neither the perpetrators or even aware that bullying has taken place.’

They claim that their proposals, made in conjunction with the GFSB, were ignored. Although the Chamber insists that it is in favour of anti-bullying legislation to prevent practices that are unacceptable, it doesn’t support legislation that ‘creates uncertainty and makes doing business in Gibraltar less attractive’.
