Sep 19 - GBGA Present UK Tax Lawsuit Next Week

gbgaWith the UK Government’s Point of Consumption tax coming into play early next month, the Gibraltar Betting and Gaming Association will present their legal challenge against the new law in the coming week.

Casinos Online reports that’s the case will be heard by the British High Court on Tuesday 23rd and Wednesday 24th September 2014. The Association will argue that the new regime is discriminatory, in breach of European law and a ‘disproportionate interference with the right to free movement of services’.

The law will see gaming operators taxed on the point of consumption of their customers, instead of the ‘place of supply’ regime, which currently sees overseas providers avoid UK gambling taxes. 

Head of Public law for Olswang, the firm representing the GBGA, claimed that the judge has taken sensible steps to ensure the case is heard expeditiously ‘before the regime is due to come into force. He added, ‘this is absolutely essential not only because we believe that this regime falls foul of European law but also because of the severe risk of detriment of consumers arising from the new law.’
