Sep 09 - Eight Acquitted In GBH Case
A group of youngsters who were due to go on trial next month for allegedly causing grievous bodily harm to a passerby were acquitted at the Supreme Court today due to a lack of evidence.
Nabil Medhurst, 19, Jairo Rivas Coca, 18, Steve Guerrero, 20, and five other defendants under the age of 18, were found not guilty of GBH with intent, violent disorder and one defendant was accused of throwing missiles.
Appearing for the Crown, Senior Crown Counsel Damian Conroy explained that the Crown was not going to put forward any evidence after two defendants did not take part in an identity parade. As a last resort they used photographs to help the victim identify his alleged attackers but he wasn’t able to recognise the individuals involved.
The Chief Justice Anthony Dudley said he has no choice but to find the eight defendants not guilty.
Patrick Canessa, Justin Rodriguez, Charles Bonfante, Elliott Phillips and Francis Borastero-Porter appeared for the defendants.
