Jan 21 – Suspended Sentence In Glass Assault Case

A woman who threw a glass at someone’s face during an altercation outside the Red Lion pub was today sentenced to six months in prison suspended for 18 months.

Daicy Montero Mancilla had last year pleaded guilty to wounding another woman in an incident that took place in November 2013.

At a sentencing hearing this morning at the Supreme Court, Puisne Judge Christopher Butler heard how Montero Mancilla had had an argument with her partner’s ex-girlfriend on the night of the 8th November 2013 outside the Red Lion pub in Watergardens.

After an exchange of words, the victim of the assault, who was sat on a bar stool, kicked Montero Mancilla striking her stomach and shin. In what was described as an “impulsive reaction” to this, Montero Mancilla threw a glass which she was holding at the victim causing cuts to her head and forehead. The head wound required 27 stitches.

In sentencing, Judge Butler said that this was “an exceptional case” because, although people can, in general, expect to be sent to prison if they commit assaults with a glass in a public place, this particular act was “entirely out of character” for the defendant.

Judge Butler accepted that the defendant did not intend to harm the victim and had reacted recklessly to provocation. He said that Montero Mancilla, who works as a carer for the elderly, had received “glowing references” and he was satisfied that there was only a “minimal risk” of re-offending.

The suspended sentence means that Montero Mancilla will not go to jail unless she offends again during the next 18 months.
