Commencement of Part 2 of the Register of Property Occupation Act

The Government has announced the commencement of Part 2 of the Register of Property Occupation Act, which was passed unanimously in Parliament and which will come into force on 1 July 2025.
As explained at the time the Bill was debated in Parliament, Part 2 of the Register of Property Occupation Act introduces a dedicated regulatory framework for Short Term Lets (STLs), in response to the sector’s rapid growth and its increasing impact on the wider real estate and tourism landscape.
Across Europe and beyond, short-term rentals have rebounded strongly since the pandemic, with Gibraltar experiencing similar trends. Consequently, it has become necessary to implement a clear and balanced system ensuring fairness and compliance across the industry.
Part 2 of the Register of Property Occupation Act builds on the existing Register of Property Occupation, following extensive collaboration between the Gibraltar Tourist Board and Land Property Services Limited.
What You Need to Know:
- New STLs must be registered BEFORE starting or advertising the rental.
- Existing STLs must be registered within 3 months (by no later than 30 September 2025).
- Private landlords will register via their eGov accounts.
- Estate agents will use their existing RPO agent accounts.
Minister for Business, Gemma Arias-Vasquez, said: “Part 2 of the Register of Property Occupation Act provides for a straightforward registration process and aims to standardise this sector of the accommodation market by establishing a simple registration and light touch regulation structure.”
Minister for Tourism, Christian Santos, said: “This framework helps create a more transparent short-term rental market with much needed clarity in the accommodation sector.”
Minister for the Environment, John Cortes, said: "This is a welcome initiative as it crystalises the product we have available in terms of the accommodation offering and significantly improves visibility of the range and types of options available at any given time."
