Oct 12 – Man Jailed For Hitting Girlfriend

A local man was sentenced to one year in prison for assault occasioning actual bodily harm after a heated argument with his girlfriend escalated and turned violent.

Clive Guerrero, 34, appeared at the Supreme Court for sentencing after pleading guilty to the charge which relates the incident which took place in June this year.

He also faced one count of making threats to kill for which he was acquitted on Monday before the start of his trial.

While sentencing today, Puisne Judge Karen Ramagge Prescott said a custodial sentence was inevitable because there were a number of aggravating factors including the fact that this had been a turbulent relationship which led to a serious domestic violence offence. She added that this offence was also committed while Guerrero was on police bail for a previous domestic violence incident and that the assault had taken place in front of their young son.

However, Ms Justice Ramagge Prescott did take into consideration that the defendant had turned down police bail to avoid contact with the victim who continues to visit Guerrero while he’s been in prison.

Guerrero was sentenced to 15 months in prison, but this was reduced to 12 months because of a late guilty plea.

Thomas Hillman appeared for the defendant and Karl Tonna appeared for the Crown.
