Insolvency (Amendment) Bill 2020
As part of its ongoing efforts to assist business during the COVID-19 pandemic, Her Majesty’s Government of Gibraltar (HMGOG) had published a Bill to amend certain provisions of the Insolvency Act 2011. The Insolvency (Amendment) Bill 2020 seeks to introduce, among other measures discussed below, a temporary moratorium period during which the ability of hostile creditors to place companies (and any other form of legal entity, sole trader or partnership) into Administration or Liquidation are suspended. It also introduces measures to protect directors (and their equivalents in other forms of legal entities), and the decision they make during the COVID-19 pandemic, to alleviate concerns regarding insolvent trading and other statutory remedies for which personal liability may arise.

As we live through our first full month in lockdown, there has not been as significant a drop in military movements to Gibraltar as one would suppose. Plenty has happened in and around our territorial limits to keep the enthusiast happy and in at least one case somewhat frustrated!

This week began with the Workers’ Memorial Day and it will end with May Day. Our current pandemic reality has cost the lives of so many essential workers. While nobody is immune to the virus, it has had an outweighed effect on the poorest neighbourhoods and on frontline workers, as well as the global south. In the UK, we know that many healthcare workers, in a National Health Service already stripped bare, have faced their death. When one’s labour is costing one’s life, it is time to sound the alarm bells. The new reality that emerges after the pandemic must come to terms with this relationship. The first place to start is re-thinking the economy, and therefore politics, at a foundational level.

Here I am writing to you all from my cave/sitting room. It's been interesting you know, living through a worldwide pandemic, these are the things I used to see in movies and be like “bahahah ni chan”. Oh boi, oh boi, oh boi was I wrong.
