May 04 - Start Of Vehicle Registration Data Exchange Regulations

As from 6th May, the Traffic (Vehicle Registration Data Exchange) Regulations 2017 commence in Gibraltar.

These Regulations transpose Directive (EU) 2015/413 on facilitating cross-border exchange of information on road-safety-related traffic offences.

The Driver and Vehicle Licensing Department (“DVLD”) is the national contact point in Gibraltar for the purposes of these Regulations and is responsible for maintaining the vehicle database and exchanging information with Member States.

The Royal Gibraltar Police have access to Gibraltar’s database and under this Directive also have access to the databases of vehicles registered in the Member States of the European Union for specific purposes. Conversely, the enforcement authorities of the Member States will have access to Gibraltar’s database for specific purposes.

These specific purposes are in order to establish the owner, holder or individual driving the vehicle who has committed one of the following offences in order to impose the relevant penalty on the person:

- speeding;

- failing to use a seat-belt;

- failing to stop at a red traffic light (or stop sign);

- drink-driving;

- driving while under the influence of drugs;

- failing to wear a safety helmet;

- the use of a forbidden lane;

- illegally using a mobile telephone or any other communication devices while driving.

The DVLD takes this opportunity to remind owners and holders of vehicles of the importance of keeping the information on the vehicle database at the DVLD up-to-date, particularly when selling, transferring title or disposing of vehicles.
