Oct 10 - Breaking: Judge Rules Against GBGA in Point of Consumption Tax Legal Battle
Lord Justice Green has ruled in favour of the UK Government in the Gibraltar Betting and Gambling Association’s case against the proposed Point of Consumption tax, to be enforced on November 1st.
eGaming Review reports that the Judge concluded that ‘the claimant has not established that the new regime is unlawful under EU or domestic law.’ Lord Justice Green went on to reject the GBGA’s passporting proposal as a potential replacement for the new regime. The Judge explained that it would not meet ‘the legitimate objectives of Parliament or prove effective or achievable without significant bureaucracy and extra cost’.
In response to the ruling the GBGA told the publication that there is now a greater need for an EU legal framework for online gambling, in order to protect European consumers.
The Judge also rejected the GBGA’s claim that the new regime would ‘lead to the creation of an illicit market of unscrupulous service providers’.
