Jan 22 - KPMG Event Discusses Updated Tax Measures and Issues Within GBGA Judicial Review

kpmg tax With a mantra of offering audit, tax and advisory services to their clients, KPMG Gibraltar yesterday hosted another of their consistently well-attended events. The ‘Tax and Audit Update’ aimed to inform clients and relevant firms on tax updates relating to announcements made in the UK Autumn 2014 Statement that will come into place this month, freshly implemented reforms in Spanish tax measures and recent developments in cases relating to tax matters between Gibraltar and the EU.

Hosted aboard the Sunborn, speakers included KPMG Gibraltar’s Greg Jones, who acts as a director for the company, Senior Tax manager from Malaga Alejandra Sanchez, Senior Gibraltar Manager Monika Samtani and Senior Tax Manager from Gibraltar, Darren Anton.

One relevant issue that were touched upon included the Gibraltar Betting and Gaming Association’s most recent challenge against the legislative framework introduced by the UK Gambling Act 2014 through a Judicial Review. In a clash over restrictions to providing services between Member States unless they are proportionate and non-discriminatory, the UK Secretary of State determined that services between Gibraltar and the UK do not constitute the provision of services between member states because the UK and Gibraltar form part of a single MS for specific purposes under Article 56, the clause being challenged.

Darren Anton noted that had the issue been touched upon before, it would have been referred to the European Court of Justice. He further discussed possible outcomes of the matter including determining whether Gibraltar is perhaps a third territory, legally and politically distinct from a member state but with a special relationship with a member state (the UK).
